Maryland requires pool fences to be at least 48 inches (4 feet) tall. Gates must be self-closing and self-latching, with the latch on the pool side at least 54 inches above grade — out of reach of small children. The fence cannot have openings that allow a 4-inch sphere to pass through (to prevent small children from squeezing through). Horizontal rails or other climbable elements on the outside of the fence are not allowed.
